Montblanc & Monochrome Sweepstake Terms & Conditions
By entering the Montblanc & Monochrome Sweepstake, you accept the following terms and conditions, which you have read and understood:?
1. One prize: ?
The winner of the Montblanc & Monochrome Sweepstakes will receive one, and only one, prize, namely, a visit to the Montblanc Watch Manufacture in Le Locle, Switzerland (hereafter the “Prize”).
The Prize will be allocated to the winner in accordance with Article 6 only. The prize is not eligible for redemption for cash from Montblanc or Monochrome. If the winner does not comply with the Official Rules at any time, the Prize will be forfeited.
2. Eligibility:
The Montblanc & Monochrome Sweepstake (hereafter the “Sweepstake”) is open to any individual who is at least eighteen (18) years old and who has chosen to enter the Sweepstake, accessible via Monochrome’s website (here), excluding employees of Monochrome and Montblanc, its related companies, and/or any other person who is connected with the creation of the Sweepstake as well as their immediate family (spouse, parents, siblings and children) and household members of each such employee. This Sweepstake is void where prohibited. No purchase is necessary to enter or win the Sweepstake. By electing to enter the Sweepstake, you warrant that you have the legal capacity to enter into the Sweepstake.
Montblanc and Monochrome will cover the visit with images and video on their channels. If you participate in the Sweepstake, you agree to be in the coverage of the visit.
3. Sponsor:
The Sweepstake is organized, administrated and operated by Monochrome and Montblanc International GmbH. Montblanc International GmbH is a company having its registered office at Hellgrundweg 100, 22525 Hamburg, Germany (“Montblanc”) and registered on the Hamburg Commercial Register. Monochrome Watches is a one-man business, registered at the Dutch Chamber of Commerce, number 51104717. Monochrome Watches is responsible for organizing the sweepstake, while Montblanc is responsible for making available the prize.
4. How to Enter
Eligible entrants may enter the Sweepstake by filling out the form accessible via this page. Additionally entrants must subscribe to the Monochrome Watches newsletter, accessible via this link. Once the entrant clicks the “SUBMIT” button on the form and has registered and verified the newsletter subscription, the entrant qualified for the Sweepstake.
Each entrant warrants that they will enter the Sweepstake one time and one time only.
5. Timing:
The Sweepstake begins on February 7, 2012 and shall end on March 8, 2013 at 18:00 p.m. CET (the “Sweepstake Period”). Monochrome’s computer clock is the official time keeping device for the Sweepstake.
6. Selection of Winners:
Monochrome will randomly select one winner from all people who entered the Sweestake and registered for the Monochrome newsletter during the Sweepstake Period. The winner will be notified of their winning status before March 31, 2013, by email.
In order to obtain their Prize, the winner must do the following (1) immediately upon notification of winning enter in his/her contact details, including email address and home address, and (2) actively help in finding/setting a date for the Montblanc Watch Manufacture visit in Le Locle, Switzerland, to take place before October 1, 2013.
If the winner cannot be contacted, or fails to comply with any of the Official Rules, the winner will be disqualified. In the event that a winner is disqualified for any reason, Monochrome and Montblanc will award the Prize in question to an alternate winner by means as noted in this Article, and the same notification and qualifying process will follow. Only five (5) alternate drawings will be held after which the Prize(s) will not be awarded.
In the event of a dispute as to the identity of a winner, the winner will be the individual who is assigned as the authorized account holder by the Internet access provider, or on-line service provider that is responsible for assigning email addresses for the domain name associated with the submitted email address at the time of submission of the winner’s email address.
7. Release:
Through receipt of the Prize, the winner agrees to release and hold harmless Monochrome and Montblanc and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, Prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property of any kind, or disappointment suffered by any entrant, arising out of or in connection to, in whole or in part, directly or indirectly, as to participation in the Sweepstake, and as to acceptance, receipt, use and/or misuse of the Prize.
8. Limitations of Liability:
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by the entrant/winner, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstake; (2) problem or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software, servers, or provider computer equipment or traffic congestion on the Internet, telephone lines or at any website, or any combination therefore, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in and/or associated with the Sweepstake; (3) unauthorized human intervention in any part of the entry process for the Sweepstake; (4) technical or human error which may occur in the administration of the Sweepstake, including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, viruses, bugs or other causes outside their control; (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant/winner’s participation in the Sweepstake and/or receipt of, use, or misuse of the Prize. No more than the stated Prize will be awarded .
?9. Disputes:
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstake and/or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the competent Courts in Hamburg, Germany; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for damages, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of the entrant and Montblanc in connection with the Sweepstake, shall be governed by, and construed in accordance with, the laws of Germany without giving effect to any choice of law or conflict of law rules.
In the event of any dispute regarding any aspect of the Official Rules, results and all other matters relating to the Sweepstake, including the selection of the winner and award of the Prizes, Montblanc’s decision shall be final and binding on the entrants.
10. General Conditions:
Montblanc reserves the right at its sole discretion to cancel, suspend and/or modify the Sweepstake and/or amend the Official Rules, in whole or in part, including the nature of the Prizes, at any time and without prior notification. In particular, Montblanc has the right to cancel, suspend and/or modify the Sweepstake, or any part of it, if any fraud, technical failures or any other factor beyond Montblanc’s reasonable control impairs the integrity or proper functioning of the Sweepstake, as determined by Montblanc in its sole discretion. Any changes to the Official Rules will be reflected on Monochrome and the entrants will be subject to the most current version of the Official Rules then in force.
Montblanc further reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstake or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner.
Montblanc further reserves the right in its sole discretion to disqualify any individual it finds submitting a written statement that it considers offensive, sexually inappropriate, libelous, or in any way inappropriate to the spirit and nature of this Sweepstake.
In the event of the Sweepstake being regarded as illegal in the country of Application users, the latter must refrain from participating.
Montblanc’s decision in all matters relating to the Sweepstake, including the operation of the Sweepstake and the selection of the (potential) winner(s) is final and binding.
